Building Regulations 2021

Building regulations were finally updated in June 2021 with significant changes made to how a notional property is calculated.  More emphasis is now proportioned on how the property is heated and how the energy used is arriving to site.

Its all about the Plant 

The commercial market is all about how the property is conditioned.  Start first with replacement of plant before looking to insulate

Gas is Bad, Electricity good

Gas has now been penalized with electricity uplifted to compensate.  LED lighting no longer has the same effect that it once had pre 2021. However is still beneficial to the overall rating.

2030 and the MEES requirements 

From 2027 EPC’s are expected to be required to meet a Grade B rating to enable lettings,  legislation shall be enforceable as of 1st of April 2030.
This is in in order to meet our Net Zero commitments

What is a Commercial EPC

 

Commercial EPC's, sometimes referred to as Non Domestic EPC’s (NDEPC) or Business EPC's  are the method in which a commercial property is scored on its carbon footprint 

They are calculated against the notional energy performance

capability of the building and expressed on an A to G colour coded bar chart scale,

 

The rating is based on the CO2 emissions of the building, factoring in the building's construction fabric and heating, cooling and lighting services. A report of recommendations accompanies the certificate and sets out suggestions to improve the energy efficiency of the building in short, medium and long payback periods

Why do you need one?

As of April 2023 every commercial property must by law have a valid EPC with a minimum rating of E this shall become uplifted to a C rating by April 2027 and looking to improve to a B rating as of April 2030. 

This changed to encompass existing tenancies as well as new on 1st of April 2023 bringing longer tenancies within the remit

Commercial property owners in England and Wales face fines between £500 and £5,000 for failing to provide a valid Energy Performance Certificate (EPC) to prospective tenants or buyers. For violating Minimum Energy Efficiency Standard (MEES)  — renting out properties with a rating below 'E'—fines can reach up to £150,000 based on the duration of non-compliance and rateable value
